Terms of Use

This English version is provided for convenience. The Arabic version is authoritative and prevails in case of any discrepancy.

1. Agreement

These Terms govern your use of the wsh app. They are an electronic agreement between you and Hisham Alashqar, its owner and operator acting as a natural person resident in the Kingdom of Saudi Arabia (“wsh” or “we”), concluded when you create an account or use the app.

By continuing, you accept these Terms and acknowledge that you have read the Privacy Policy. If you do not accept them, do not use the app.

2. The Service

wsh is a social service for creating and sharing wish lists and occasions with friends, reserving a wish to avoid duplicate gifts, confirming gifting, and sending thanks.

3. Account

An account is created using a mobile number verified by a one-time code. You must be authorised to use the number, provide an accurate name, and protect your device and verification code. We will never ask for the code outside the official verification screen; if you lose control of your number or account, tell us immediately. You must not impersonate another person or use their account, or create accounts to evade a prior suspension or to harm the Service or its users.

4. Content and Acceptable Use

Your content — wish names, images, notes and links, and occasion titles — remains yours or the relevant rights holder's. You grant us a non-exclusive, royalty-free licence limited to storing and technically processing it, displaying it to authorised users, and operating the Service. It ends when the content or account is deleted, subject to the retention periods described in the Privacy Policy.

You are responsible for your content and for having the right to use it. You must not:

When we become aware of a violation we may remove content, restrict access to it, or restrict the account to the extent necessary — which does not mean we review all content before it is published.

5. Reservations and Delivery Data

The gifter may cancel an active reservation before confirming the gift; afterwards it can no longer be cancelled through the Service.

Providing a Short National Address or an email address is optional, and either may be made available to the reserving friend for the purpose of delivering the gift. The data is captured at reservation time, so a later edit does not change an existing reservation. The gifter must use it only to complete the gift, share it only with the store or delivery company to the extent necessary, and not retain it after that purpose has ended.

6. Availability and Changes to the Service

The Service is provided as available. It may pause for maintenance or technical reasons, we do not guarantee error-free or uninterrupted operation, and we may develop, change, or discontinue its features. If a paid service is introduced, its price and terms will be shown clearly, and no amount will be charged without an express action by you.

7. Account Restriction and Deletion

You can request account deletion from inside the app; the Privacy Policy explains what is deleted and what may remain for a limited period or in a record belonging to another user. We may restrict or suspend an account for breach of these Terms, harm to a user or the Service, security necessity, or compliance with law or a request from a competent authority; data is then handled in accordance with the Privacy Policy and applicable law.

8. App Rights and Responsibility

Rights in the name, logo, design, interfaces, code, and content we create are owned by or licensed to us. Use of the app gives you no right to copy or exploit them outside ordinary use of the Service.

wsh does not control user content or conduct, or external stores, products, or delivery services. Liability for any damage and compensation is determined under the laws in force in the Kingdom. These Terms do not exclude any liability or right that cannot lawfully be excluded, including our personal-data protection obligations.

9. Changes to These Terms and Governing Law

We may update these Terms when the Service or legal requirements change; the latest revision date appears above. If a change requires fresh acceptance, we will request it before applying it to you.

These Terms are governed by the laws of the Kingdom of Saudi Arabia, and its competent judicial authorities have jurisdiction over any dispute arising from them. The Terms are prepared in Arabic and English; the Arabic text prevails in case of discrepancy.
